Welcome to Here in Southwest Florida, owned and operated by A Better Solutions Consulting, LLC, d/b/a Here in Southwest Florida (“we,” “us,” or “our”).

By accessing or using HereInSouthwestFlorida.com or related services (collectively, the “Site”), you agree to these Terms of Service. If you do not agree, please do not use the Site.

1. Purpose of the Site

Here in Southwest Florida is a local business and community directory designed to help visitors discover businesses, services, restaurants, attractions, events, and other resources throughout Southwest Florida.

We provide directory information for general informational purposes. Inclusion in the directory does not constitute our endorsement, certification, or guarantee of any business, service, product, or individual.

2. Business Listings

Some listings may be submitted directly by business owners, while others may be created using publicly available business information.

Although we work to keep listings accurate, we do not guarantee that every name, address, telephone number, business hour, description, price, service, or other detail is complete or current.

Business owners may contact us to claim, correct, update, or request removal of a listing. Anyone claiming or managing a listing represents that they are authorized to act on behalf of that business.

3. User-Submitted Content

Users and business owners may submit information such as descriptions, photographs, logos, reviews, events, deals, job postings, articles, and other materials.

By submitting content, you confirm that:

• You own the content or have permission to use it.
• The content is accurate and not misleading.
• The content does not violate another person’s rights or any applicable law.
• The content does not contain malicious code, unlawful material, or unauthorized personal information.

You retain ownership of your content but grant us a nonexclusive, worldwide, royalty-free license to display, format, reproduce, and promote it in connection with the directory and its marketing.

We may review, edit, reject, or remove submitted content at our discretion.

4. Reviews and Community Conduct

Reviews must reflect genuine experiences and must not contain threats, harassment, discrimination, obscenity, false statements, spam, or conflicts of interest that are not disclosed.

Businesses may not submit fake reviews, compensate someone for a positive review without proper disclosure, or attempt to manipulate ratings.

We may remove reviews or other content that violate these Terms, but we are not obligated to independently verify every submission.

5. Paid Listings and Promotional Services

We may offer paid listings, featured placement, enhanced profiles, advertising, or other promotional services.

Pricing, features, billing frequency, renewal terms, and cancellation conditions will be disclosed when the service is purchased. Unless otherwise stated at checkout, recurring services automatically renew until canceled.

Canceling a recurring service prevents future renewals but does not ordinarily provide a refund for a billing period that has already begun. We may change future pricing or features after providing reasonable notice.

Featured or paid placement does not represent a guarantee of leads, sales, website traffic, search-engine rankings, or business results.

6. Payments

Payments may be processed by third-party payment providers. We do not directly store complete payment-card information.

You agree to provide accurate billing information and authorize the applicable charges associated with your selected service.

7. Prohibited Uses

You may not use the Site to:

• Violate any law or regulation.
• Submit false, fraudulent, defamatory, or misleading information.
• Impersonate another person or claim a business without authorization.
• Scrape, copy, resell, or systematically extract directory content without permission.
• Disrupt the Site or transmit harmful or malicious code.
• Collect information about other users for unsolicited marketing.
• Infringe intellectual-property, privacy, or other legal rights.

8. Intellectual Property

The Site’s design, branding, text, software, graphics, and original content are owned by us or used with permission and are protected by applicable intellectual-property laws.

Business names, logos, photographs, and trademarks displayed within individual listings remain the property of their respective owners.

9. Third-Party Businesses and Websites

The Site contains information about independent businesses and may link to third-party websites, social-media pages, booking systems, maps, or payment services.

We do not control these third parties and are not responsible for their content, availability, products, services, privacy practices, pricing, or conduct.

Any transaction or interaction with a listed business is solely between you and that business.

10. Disclaimer

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied.

We do not guarantee the accuracy of listings, the quality of any listed business, uninterrupted access to the Site, or any particular result from using the directory.

11. Limitation of Liability

To the fullest extent permitted by law, Here in Southwest Florida and A Better Solutions Consulting, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or interactions with any listed business.

12. Suspension or Termination

We may suspend or remove listings, accounts, or content that violate these Terms, create legal or security concerns, or harm the directory or its users.

13. Changes to These Terms

We may update these Terms periodically. Changes become effective when posted with an updated revision date. Continued use of the Site after an update constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute relating to these Terms or the Site will be handled in a court of appropriate jurisdiction in Lee County, Florida.
